Legislative Yuan Passes Intellectual Property Court Organic Act


     On March 5, the Legislative Yuan passed the IP Court Organic Act, authorizing the Judicial Yuan to establish a court to hear cases related to intellectual property. The new act, together with the IP Case Proceeding Act (which was passed in January), will now be sent to the Presidential Office for promulgation, at which time the IP court will begin operating. The new court will have technical investigators assigned to handle IP court cases with the aim of strengthening the protection of IP rights through a professional division of labor.

 

The new Act stipulates that the scope of the IP court will encompass civil, criminal, and administrative cases related to IP. The location of the court is to be determined by the Judicial Yuan, which may also establish branch courts if necessitated by the geographic environment or by the number of cases.
