2.1.  GENERAL

2.1.1.  ACCEPTANCE OF CONSIGNMENTS Consignments are accepted by carriers: a. through IATA Cargo agents. In such cases the consignments shall be ready for carriage in accordance with Rule 2.3.2., or b. directly from shippers, in which case they shall be prepared for carriage in accordance with the other rules hereafter, provided there is no embargo established by a carrier involved in the total transportation. For embargoes refer to Rule 2.3.3.

D. 2.1.2.  RESPONSIBILITY OF SHIPPER The carrier or its duly authorized agent for and on behalf of the shipper or consignee may, but shall not be obligated to, comply with the formalities required by customs and other Government authorities and may, but shall not be obligated to, advance any duties, taxes and other charges and make any disbursements; and the shipper, consignee and owner of the goods shall be jointly and severally liable to the carrier for the reimbursement of any payments so made. For any such purpose, a copy of the Air Waybill certified by the carrier shall be deemed an original. The shipper is obligated to comply with all customs regulations and other governmental regulations of any country flown from, to, or over relating to the packing, carriage, and delivery of goods, including the furnishing of such information and documents as may be necessary to meet such requirements; however, the carrier is under no obligation to inquire into the correctness or sufficiency of required information, documents or marking.

  2.1.3.  CARRIERS' LIABILITY 1. Carrier is liable to the shipper, consignee or any other person for damage sustained in the event of destruction or loss of, or damage to, or delay in the carriage of the cargo only if the occurrence which caused the damage so sustained took place during the carriage. 2. To the extent provided by applicable convention, carrier's liability shall be limited to the amount stipulated in such applicable convention notwithstanding the existence of gross negligence or wilful misconduct on the part of the carrier. 3. Except as may be otherwise provided for in any applicable Convention, carrier is not liable to the shipper, consignee or any other person for any damage, delay or loss of whatsoever nature arising out of or in connection with the carriage of cargo or other services performed by carrier or its agents, unless such damage, delay or loss is proved to have been caused by the gross negligence or wilful misconduct of carrier 4. Carrier is not liable if the destruction, loss of or damage to cargo is proved to have resulted solely from the inherent defect, quality, nature or vice of that cargo. 5. Carrier will not be liable for any loss, damage or expense arising from death due to natural causes or death or injury of any animal caused by the conduct or acts of the animal itself or of other animals such as biting, kicking, goring or smothering, nor for that caused or contributed to by the condition, nature or propensities of the animal, or by defective packing of the animal, or by the inability of the animal to withstand unavoidable changes in its physical environment inherent in the carriage. 6. To the extent not in conflict with applicable law, the carrier shall not be liable in any event for any consequential loss or damage arising from carriage subject to these conditions, whether or not carrier had knowledge that such loss or damages might be incurred. 7. Contributory negligence on the part of the shipper, consignee or other claimants releases the carrier of its libility to the extent provided by applicable convention and applicable law. 8. Liability of carrier shall not exceed the applicable Convention limit or, if no Convention applies, 17 Special Drawing Rights, per kilogram of cargo destroyed, lost, damaged or delayed. If with the agreement of the carrier , the shipper has made a special declaration of value for carriage and has paid the supplementary sum applicable, it is agreed that any liability shall in no event exceed such declared value for carriage stated on the face of the Air Waybill or included in the shipment record. All claims shall be subject to proof of value. 9. In the case of loss, damage or delay of part of the shipment, or of any object contained therein, the weight to be taken into consideration in determining the amount to which carrier's liability is limited shall be only the weight of the package or packages concerned. Nevertheless, when the loss, damage or delay of part of the shipment, or of an object contained therein, affects the value of other packages covered by the same Air Waybill, the total weight of such package or packages shall also be taken into consideration in determining the limit of liability. In the absence of proof to the contrary, the value of any such part of the shipment lost, damaged or delayed as the case may be, shall be determined by reducing the total value of the shipment in the proportion that the weight of that part of the shipment lost, damaged or delayed has to the total weight of the shipment. 10. The shipper, and to the extent permitted by applicable law, the owner and consignee whose property or shipment causes damage to or destruction of another shipment or of the property of carrier, shall indemnify carrier for all losses and expenses incurred by carrier as a result thereof. Cargo which, because of inherent defect, quality or vice or because of defective packing, is likely to endanger aircraft, persons or property may be abandoned or destroyed by carrier at any time without notice and without liability therefore attaching to carrier. 11. A carrier issuing an Air Waybill for carriage over the lines of another carrier does so only as agent for such other carrier. Any reference in a shipment record to carriage to be performed by another carrier shall be deemed to refer to carriage to be provided as principal by such other carrier. No carrier shall be liable for the loss, damage, or delay of cargo not occurring on its own line except that the shipper shall have a right of action for such loss, damage or delay on the terms herein provided against the first carrier and the consignee or other person entitled to delivery shall have such a right of action against the last carrier under the contract of carriage. 12. Whenever the liability of carrier is excluded or limited under these conditions, such exclusion or limitation shall apply to agents, servants or representatives of carrier and also to carrier whose aircraft or other means of transportation is used for carriage. 13. For international carriage carriers' liability is limited to USD 20.00 or its equivalent per kg. (but under no circumstances more than the actual value of the goods at destination). If the shipper wants the carrier to assume liability up to an amount exceeding USD 20.00 or its equivalent per kg, he must declare such amount as value for carriage and pay the applicable valuation charge outlined in Rule 3.2.

2.1.4.  LIMITATIONS ON CLAIMS AND ACTIONS

1. Receipt by the person entitled to delivery of the cargo without complaint is prima facie evidence that the same has been delivered in good condition and in accordance with the contract of carriage.

2. No action shall be maintained in the case of loss or damage to goods unless a complaint is made to carrier in writing by the person entitled to delivery. Such complaint shall be made: a. in the case of visible damage to or partial loss of the goods, immediately after its discovery and at the latest within fourteen (14) days from the date of receipt of the goods; b. in the case of other damage to the goods, within fourteen (14) days from the date of receipt of the goods; c. in the case of delay, within twenty-one (21) days from the date on which the goods were placed at the disposal of the person entitled to delivery; d. in the case of non-delivery of the goods, within twenty-one (21) days of the date the goods ought to have arrived at destination. 3. The right to damages shall be extinguished if an action is not brought within 2 years, reckoned from the date of arrival at the destination, or from the date on which the aircraft ought to have arrived, or from the date on which the transportation stopped. The method of calculating that period shall be determined by the law of the court seized of the case.

  2.1.5.  OVERRIDING LAW To the extent that any provision contained or referred to herein is contrary to anything contained in the applicable convention, and in any applicable laws, government regulations, orders or requirements that cannot be waived by agreement of the parties, such provision shall not apply. The invalidity of any provision shall not affect the validity of any other provision contained herein

. 2.1.6.  MODIFICATION AND WAIVER No agent, servant or representative of carrier has authority to alter, modify or waive any provision of the contract of carriage or of these conditions.

2.1.7.  CARRIERS' RIGHT OF INSPECTION Carrier reserves the right to examine the packaging and contents of all shipments and to enquire into the correctness or sufficiency of information or documents tendered in respect of any shipment but carrier shall be under no obligation to do so.  

3.1.  GENERAL The "rate" is the amount charged by the carrier for the carriage of a unit of weight (kg. or lb.).Applicable rates are the published rates in effect on the date of issuance of the air waybill by the carrier or its agent. (For charges collect shipments see Rule 5.4.1. paragraph 3).The "charge" is the amount to be paid for the transportation of a consignment or for incidental service(s) in connection with such transportation. It depends on the value declared for carriage by the shipper and on the weight/volume of the consignment. Calculation of charges for all shipments shall be made by multiplying the applicable rate per kg/lb by the chargeable weight. There are various different types of cargo rates and charges:   a. Minimum Charges In no event shall the charge for any consignment be less than the minimum charges shown in the Rates books or in Rule 3.4.2.   b. General Cargo Rates (GCR) General cargo rates apply for the carriage of commodities which have not been allocated a specific commodity rate as described in c. below. The Normal General Cargo Rates published apply to consignments up to 45 kgs., or where no under 45 kgs. rate exists, to consignments up to 100 kgs. Lower general cargo rates for various weight breakpoints are available for larger shipments in many areas of the world.   c. Specific Commodity Rates (SCR) Specific commodity rates are usually lower than general cargo rates and are published for particular commodities from a specified point of origin to a specified destination point. They are subject to a minimum weight and may implement special conditions relating to minimum charges and density requirements.   d. Class Rates Commodity classification rates, known as class rates, apply to a few commodities within or between certain designated areas. They are usually stated in terms of a percentage increase or reduction in the normal general cargo rates.   e. Unitized consignments Special rates may apply to consignments presented in Unit Load Devices (ULD), see Rule 3.10.

3.2.  VALUATION CHARGES 1. Shippers must declare a value for carriage on the AWB. This declaration may be a specific amount or NVD (No Value Declared). For the purpose of applying valuation charges, the value per kilogram or per pound must be determined by dividing the shipper's declared value for carriage by the gross weight of the consignment as declared in the Gross Weight box on the AWB. Declared value for carriage may not be entered or (if already entered on the AWB) amended after despatch of the shipment from the airport (or city) of departure shown on the AWB. 2. Consignments valued at more than SDR 17 per kg. will be assessed valuation charges of 0.50% (from Singapore to the USA: 0.40%) of the Shipper's declared value for carriage exceeding SDR 17 per kg 1) . d. Applicable to Air Canada Domestic/Transborder and International shipments 1) The shipper must make a declaration of value for carriage on the AWBs of all shipments, regardless of whether or not charges based on value are applicable. 2) Except as provided in paragraph (3) below, such declaration of value may be in any amount, provided that "NVD" (No Value Declared) may constitute such declaration. 3) In the case of shipments consisting of valuable cargo (as defined in Rule 3.7.6.), the shipper must either: (a) declare a value for carriage which cannot be less than: -  the declared value for customs, or -  the insurance amount, or -  the amount stated on the shipper's commercial invoice, or -  the amount stated on the customs export documents, or -  the amount stated in a verbal declaration by the shipper OR (b) purchase insurance through the carrier for the actual value of the goods. 3. The declared value for carriage applies for the actual gross weight of the consignment, excluding the weight of airline owned ULD's. Value declarations for individual parts of the shipment only or higher or lower value declarations for some parts of a shipment are not possible.

3.3.  PRECEDENCE OF RATES AND CHARGES Through published rates take precedence over any combination of sector rates of the same type, between the same points via the same Carriers.   For combination of rates see Rule 3.8.As a rule the following order of precedence applies to the published through rates: a. Specific commodity rates take precedence over Class rates and General cargo rates. b. Class rates take precedence over General cargo rates. c. When the General cargo rate applicable to the consignment is lower than the Specific commodity rate, such lower rate can be applied except where the Specific commodity rate has been established for items covered by a Class rate. d. Where the General cargo rate applicable to a consignment of newspapers, magazines, periodicals, books, catalogues, braille type equipment, talking books for the blind and/or baggage shipped as cargo is lower than the Class rate, such lower rate can be applied.

3.4.1.  GENERAL 1. When the weight or volume charge for a consignment is lower than the minimum charge, the minimum charge shall apply. The minimum charge takes precedence over: a) any lower combination of minimum charges b) any lower charge resulting from applying charges contained in another rule (unless specifically provided in that rule). 2. Any valuation charge shall not be included with the weight or volume charge. 3. Minimum charges apply on a per consignment basis. 4. Minimum charges to destinations not published in the Rates books are as indicated in Rule 3.4.2. below.

3.5.  GENERAL CARGO RATES

3.5.1.  GENERAL The General cargo rates (GCR) are published in the Rates books, Section 4.3.

3.5.2.  NORMAL GENERAL CARGO RATES The normal general cargo rate is the under 45 kgs. rate or, where no under 45 kgs. rate exists, the under 100 kgs. rate.   For most countries, the Normal general cargo rate is applicable to consignments of less than 45 kgs. For some countries, however, the normal general cargo rate will apply to consignments of up to 100 kgs.   Exception: Within Europe Between a number of countries in Europe a different rating structure is applicable. This consists of a basic charge per shipment - regardless of its weight - plus a rate per kilogram. These charges and rates are as published in the Worldwide Rates Book, Section 4.3.The basic charge is referred to as "B" while the rate per kilo is shown as "K".Fractions of a half kilogram must be charged for as the next higher half kilogram. Normal density rules apply to this structure.  

3.6.  SPECIFIC COMMODITY RATES

3.6.1.  GENERAL The specific commodity rates (SCR) are published in the Rates books, Section 4.3. For definitions, descriptions and guidelines regarding application of specific commodity rates see Section 2 of the Rates books.  

3.6.2.  PRECEDENCE OF SPECIFIC COMMODITY RATES When a commodity can be classified and rated under more than one description, the most specific description shall prevail, even if this means a higher charge. However, a less specific description applicable to both a lower minimum weightbreak and a higher rate may be used, until the more specific description at the higher minimum weightbreak and a lower rate becomes applicable.

3.7.1.  GENERAL 1. Commodities Listed below are those commodities for which class rates have been established. In the absence of a Specific Commodity Rate for any of these items, the proper rate is to be determined by applying the percentage indicated below to the normal rate shown for the cargo in question. Within Europe, however, where a tariff comprising a Basic Charge plus a rate per kilogram is applicable, Class Rates are determined in accordance with paragraph 3. below. The minimum charges (as published in Rule 3.4.2. and in the Rates books) will apply to class rated consignments unless otherwise indicated. 2. Combination of rates Where carriage of class rated consignments is over the lines of two or more carriers, the through IATA rate will apply from origin to destination unless a carrier indicates a special percentage requirement for its portion of the carriage. In that case the through IATA rate will not apply and the applicable charge will be the combination of the local sector rates of each participating carrier. 3. Within Europe Listed below are those commodities for which Class Rates in the Basic charge structure have been established. The correct rate/charge is determined by applying the percentage indicated below to the basic charge (B) first and then to the rate per kilogram (K) *).See Rule 6.3. AWB completion examples 8 and 12. 3.7.2. LIVE ANIMALS 1. Rates covering all areas, excluding to/from USA/US territories (except from South West Pacific to USA/US territories).   The rates for live animals as stated below are to be determined as follows. Where the rate is stated: a. as a percentage of the Normal GCR (i.e. "150% of the Normal GCR"), such percentage is to be applied to the normal under 45 kgs. general cargo rate or where no under 45 kgs. general cargo rate exists, to the under 100 kgs. general cargo rate (see also Rule 3.5.2.) regardless of the weight of the consignment. b. as "the Normal GCR", apply the normal under 45 kgs. general cargo rate or where no under 45 kgs. general cargo rate exists, the under 100 kgs. general cargo rate (see also Rule 3.5.2.) regardless of the weight of the consignment. c. as (a percentage of) "the applicable GCR", apply (such percentage) to the general cargo rate applicable to the weight of the consignment. d. as "the Normal GCR or the over 45 kgs. GCR", apply the normal under 45 kgs. general cargo rate or the over 45 kgs. general cargo rate as applicable. If lower GCR's exist at higher weightbreak points, such lower rates shall not be used. Where two different percentages exist i.e. one for the country of destination and one for the country of origin, the percentage of the country of origin prevails. The weight of the animal container, food etc. will be included in the chargeable weight of the consignment.

Exception: From Italy to European destinations on Lufthansa Cargo Services 250% of the applicable minimum charge. d. Within IATA Area 3: 200% of the applicable minimum charge. e. Between IATA Areas 1 and 2: 200% of the applicable minimum charge. Exception: For the carriage of horses the minimum charge per pallet shall be the minimum charge for a type 3 ULD. f. Between IATA Areas 2 and 3: 200% of the applicable minimum charge. g. Between IATA Areas 1 and 3: 200% of the applicable minimum charge.

3.7.6.  VALUABLE CARGO 1. Definition Valuable cargo means a consignment which contains one or more of the following articles: a. any article having a declared value of carriage of USD 1000.00 (or equivalent) or more, per gross kilogram; except in the United Kingdom GBP 450.00, or more per gross kilogram; b. gold bullion (including refined and unrefined gold in ingot form), dore bullion, gold specie and gold in the form of grain, sheet, foil, powder, sponge, wire, rod, tube, circles, mouldings and castings, platinum, platinum metals (Palladium, iridium, ruthenium, osmium and rhodium) and platinum alloys in the form of grain, sponge, bar, ingot, sheet, rod, wire, gauze, tube and strip (but excluding those radioactive isotopes of the above metals and alloys which are subject to restricted articles labelling requirements); c. legal banknotes, traveller's cheques, securities, shares, share coupons and stamps (excluding mint stamps from United Kingdom) and ready for use bank cards and/or credit cards; d. diamonds, (including diamonds for industrial use), rubies, emeralds, sapphires, opals and real pearls (including cultured pearls); e. jewellery consisting of diamonds, emeralds, sapphires, opals and real pearls (included cultured pearls); f. jewellery and watches made of silver and/or gold and/or platinum; g. articles made of gold and/or platinum, other than gold and/or platinum plated.   2.   2. Quantity Rate Where a General Cargo Quantity Rate results in a lower charge than the rate established by this rule, such lower rate shall apply.   3. Minimum charge The minimum charge shall be the normal minimum charge as published in section 4.3. of the Rates books and in Rule 3.4. 3.7.8.  BAGGAGE SHIPPED AS CARGO 1. Applicability a. Within IATA Area 2 (except wholly within Europe); b. Within IATA Area 3 (except from US territories); c. Between IATA Areas 2 and 3 (except to/from US territories); d. Between IATA Areas 1 and 2 (except to/from USA, US territories and except to/from Greenland); e. From IATA Area 3 to IATA Area 1.   2. General Baggage shipped as cargo shall consist of only personal wearing apparel and personal articles of a passenger (including portable musical instruments, portable typewriters and portable sports equipment but excluding machinery, machine or spare parts, money, securities, jewellery, watches, plate and plated ware, furs, films, cameras, tickets, documents, liquors, perfumes and articles of household furnishing, merchandise and salesman samples). Note Special rates may exist for golf and ski equipment, surfboards and sailboards (wind surfing equipment). Information may be obtained from individual carriers.   3. Conditions a. Shipments at these rates will be carried only between the same points (airports only) for which the passenger holds a ticket, provided that the baggage is delivered not later than the date of the passenger's departure; b. The passenger using this facility must make a declaration of the contents of the baggage, complete all documents required for dispatch and customs, and be responsible for all additional charges for collection, delivery and customs. The baggage shall be cleared through customs by the passenger personally or by his agent; c. The ticket(s) numbers, the flight/line numbers and the date(s) of the services on which the passenger is travelling must be inserted on the air waybill; d. It shall be within the discretion of the carrier on which flight the baggage is carried; e. The rate may not be combined with any normal GCR or SCR to result in a combination which is less than the applicable specified or constructed cargo rates. f. Other than those conditions described above, for any other routing the existing General Cargo Rates and Specific Commodity Rates will apply.   4. Rating

  2. Minimum charge
For transportation of human remains the normal minimum charges are applicable, except for transportation wholly within IATA Area 2 a minimum charge will be levied of 200% 1) of the applicable minimum charge, provided that this shall not be less than USD 65.00 ²) or equivalent. Exceptions

3.7.11.  AUTOMOTIVE VEHICLES For transportation of automotive vehicles: a. from Japan to Europe and the South West Pacific sub-area, the Normal GCR applies; b. between IATA area 1 and IATA area 3, except to/from the South West Pacific sub-area and South Asian Subcontinent, the Normal GCR applies.
